Terms and Conditions

For the purpose of this agreement, “the artist” refers to Bhavik Haria.

1. Booking Confirmation
1.1. A booking is confirmed upon receipt of payment as outlined in Section 2: Payment Terms.
1.2. Until confirmation, availability cannot be guaranteed.

2. Payment Terms
2.1. Short-Notice Bookings (within 30 days of the event):
2.1.1. Full payment is required at the time of booking.
2.2. Bookings More Than 30 Days in Advance:
2.2.1. A 50% non-refundable deposit is required to secure the booking.
2.2.2. The remaining balance must be paid in full 10-14 days prior to the event date.
2.3. On-the-Day Payment:
2.3.1. For specific engagements, where agreed in advance, the fee may be payable on the day of performance.

3. Cancellation Policy
3.1. Client Cancellation:
3.1.1. Cancellations more than 30 days prior to the event: The deposit is non-refundable but may be applied to a future booking, subject to availability.
3.1.2. Cancellations within 30 days of the event: No refunds will be issued.
3.2. Artist Cancellation:
3.2.1. In the unlikely event the artist must cancel, a full refund will be provided, or a suitable replacement performer will be arranged with the client’s approval.
3.2.2. If another artist booked through the main artist is unable to perform:
3.2.2.1. The artist will make every reasonable effort to arrange a suitable replacement, subject to the client’s approval.
3.3. Limitation of Liability for Other Artists:
3.3.1. The artist is not liable for the acts, omissions, negligence, or conduct of other artists booked for the performance, whether recommended by or arranged through the artist.
3.3.2. The artist’s total liability for any claim arising from the event is limited to the total fees paid by the client.

4. Setup and Sound Check
4.1. The artist requires access to the venue at least 2 hours prior to the performance for setup and sound check. The client is responsible for ensuring this access.
4.2. The client must provide a secure, private room or space for the artist and personnel, located away from the main performance area, for use before, during, and after the performance.

5. Equipment and Technical Requirements
5.1. The client must provide appropriate staging, sound systems, and lighting if not included in the artist’s services. Specific requirements will be outlined in advance if required.
5.2. The equipment and instruments of the musicians are not available for use by any other person without specific permission from the musician.
5.3. The client must ensure a safe and reliable electricity supply at the venue.

6. Performance Times
6.1. The agreed performance start and end times must be adhered to.
6.2. Requests for extended performance times are subject to the artist’s availability and additional fees may apply.
6.3. Delays caused by the client or guests may result in a shortened performance time without a refund.

7. Travel and Accommodation
7.1. For events outside the M25 (London Orbital Motorway), the client is responsible for covering travel expenses, which will be included in the quotation.
7.2. If overnight accommodation is required, it must be provided by the client and approved by the artist in advance.

8. Meals and Refreshments
8.1. For performances exceeding 3 hours, the client must provide meals and non-alcoholic refreshments for the artist and accompanying personnel.

9. Behaviour, Safety, and Security
9.1. The artist may terminate the performance if safety is compromised due to disruptive behaviour, intoxication, or disorderly conduct from guests or staff, with no refund provided.
9.2. The client is responsible for the security of the musicians and their equipment.
9.3. Both parties agree to maintain a “Safe Space” free from harassment and discrimination.

10. Copyright and Recordings
10.1. The client shall not make, or permit the making of, any audio or visual recording or transmission of the performance without prior written consent from the artist.
10.2. The client and guests are permitted to post photos, videos, or clips of the performance on social media, provided that the artist is appropriately tagged or credited in all posts.
10.3. The artist retains copyright of all original material performed during the event.

11. Liability
11.1. The artist is not responsible for delays, interruptions, or cancellations caused by circumstances beyond their control (e.g., extreme weather, natural disasters, or emergencies).
11.2. The artist is insured for legal liability arising from injury or damage to members of the public, with a limit of indemnity of £10 million. This coverage applies during performances, rehearsals, auditions, teaching, and while in transit to and from the event.

12. Late Payments
12.1. Failure to pay the balance by the due date may result in cancellation of the booking without refund of the deposit.

13. Contractual Changes
13.1. This agreement may not be modified or cancelled except by mutual consent in writing, signed by both parties.
13.2. Any rider attached to this agreement and signed by both parties shall be deemed incorporated into this agreement.

14. Force Majeure
14.1. Neither party shall be held liable for failure to perform due to events beyond their control, such as natural disasters, acts of war, or government restrictions.

15. Confidentiality
15.1. All personal and event details provided by the client will be kept confidential and used solely for the purpose of organising the performance.

16. Governing Law
16.1. This agreement is governed by the laws of England and Wales.

By making payment to us, you confirm you have read and are agreeable to the above terms.
